Clarke ORDINANCE NO. 9927 AN ORDINANCE CLOSING AND ABANDONING WOODLAND AVENUE LOCATED NORTHEAST FROM NOLL STREET, BETWEEN FRANKLIN STREET AND FOREST AVENUE, MORE PARTICULARLY DESCRIBED HEREIN, SUBJECT TO CERTAIN CONDITIONS. _______________________ SECTION 1. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby closed and abandoned Woodland Avenue located northeast from Noll Street, between Franklin Street and Forest Avenue, more particularly described herein, and as shown on plat attached hereto and made a part hereof by reference: Woodland Avenue, a 50 foot wide unopened right-of-way beginning on the northeast line of Noll Street (formerly Hill Street) 73.1 feet southeast of the intersection of the northeast line of Noll Street with the southeast line of Franklin Street, thence northeast some 315 feet with the northwest line of Woodland Avenue to a point in said line 50 feet northwest (if measured at a right angle) of the northwest corner of lot 3, block E, Frazier and Colville's Addition to Hill City, as shown by plat of record in plat book 4, page 28, ROHC, thence southeast 50 feet to the northwest corner of said lot 3, thence southwest 300 feet with the southeast line of Woodland Avenue to the northeast line of Noll Street, thence northwest some 52 feet with Noll Street to the point of beginning. Said street separates lots 1-3, block 0C E, said Frazier and Colville's Addition, from part of Sylvan Park, as designated on said subdivision plat. Tax Map No. 135D-N-1 and 14-16. SECTION 2. BE IT FURTHER ORDAINED, That this closure and abandonment is made subject to the following conditions: 1. The City of Chattanooga has a sewer located within said right-of-way and reserves an easement the width of the right-of-way for the purpose of maintaining said sewer. 2. The City's Public Works Administrator recommends approval of this abandonment provided resubdivision is done. 3. The areas reserved for utility easements must be kept free and clear of all structures. 4. All existing easements are retained. SECTION 3. BE IT FURTHER ORDAINED, That this Ordinance shall take effect two weeks from and after its passage as provided by law.
